Both properties (Riad Najmati and Les Noyers) are also our homes. But as we cannot be in them all the time we would like others, especially our friends, to enjoy them. We look after them as best we can and would respectfully ask you to do the same. We believe the rent is fair. We only insist on your agreeing to the terms and conditions (or ‘Contract’) below for your protection and peace of mind, as much as ours. The Contract shall be governed by English Law.

If you wish to have clarification on any matter please enquire before making your booking.

It is our wish that you enjoy your holiday and we will do everything reasonable to ensure you have a happy, relaxing and safe time.

By booking your holiday with Richard Kirker Holiday Villas you agree to the following terms and conditions:

That you are over 18 years of age and that you accept full responsibility for all payments due and for the consequences of any actions of all persons who will use the house/riad during your holiday. Whatever the method of payment you will have been deemed to have read all the Booking Conditions and agreed to be bound by them.

That you provide a full name, postal address, telephone number(s) and (where available) an email address.

Payment

Payment in full 6 weeks before your arrival.

Less than 6 weeks in advance – by agreement.

If payment received 12 or more weeks in advance of arrival 10% reduction.

We will send you a confirmation, by post or email, upon receipt the payment.

No further reminders will be sent.

Cheque payable to Richard Kirker.

No booking will be deemed to have been confirmed until full payment has been received. In the case of a cheque this means the payment has been transferred from your account to Richard Kirker’s account. Payment can only be accepted by cheque denominated in sterling (UK pounds GBP) or, by agreement, Euros.

Cancellation and Insurance

Once you have booked your holiday, our agreement with you is a legal contract. If you cannot go on holiday for any reason and the house/riad cannot be re-let, you are liable to pay for the booking in full. If we succeed in re-letting the house/riad for that same period we will return the payment less £35 administration fee. For this, and other good reasons (ie health) we strongly recommend that you take out full insurance for your holiday.

If returning a payment it will be made in Sterling (UK pounds) or Euros by cheque.

Non-availability of house/riad as booked

We would only cancel your holiday if the house/riad was unavailable for reasons beyond our control. In the unlikely event of this happening, we would attempt to offer you alternative accommodation. If this was either not possible or not acceptable to you then we would refund to you all monies paid for the holiday. Our liability to you would not extend beyond this refund.

Arrival

Your house/riad will usually be ready for you from 12.00pm on the day of your arrival, unless otherwise agreed in advance.

Riad Najmati: If you wish to arrive earlier/depart later we will arrange for storage of your baggage. Cost of taxi on arrival (if requested and paid in advance) and breakfast is included.

Departure

We strictly require that you vacate your house/riad by 10am on the morning of your departure, unless otherwise agreed. To assist our cleaners, we ask that you leave the property in a clean and tidy condition.

Departure Invoice

Although the cost of heating, linen, light and power is all inclusive in your holiday cost we will present if necessary an invoice at the end of your holiday for sundry costs such as the use of logs, breakages, damage, and extra cleaning. We prefer this system rather than requiring in advance a returnable deposit and hope you will respect the trust we are placing in you to honour such an invoice if presented.

Liability

We do not accept responsibility for injury to persons or loss/damage to possessions unless caused by proven negligent act or omission of ourselves, our employees or contractors, or agents of the same, whilst acting in the course of their employment. This includes loss or damage to vehicles and their contents, and to the personal possessions you bring with you.

Complaints

Should you find any faults or have any complaints during your stay, please advise me immediately so that any appropriate action can be taken. We will not normally make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to us during the holiday rental period.

Any unresolved disputes may be referred to arbitration.

Damage and Breakages

You are responsible for any breakages or damage you or your pets cause to the house/riad and its contents. Please report these before you leave.

Occupation of the house/riad

You must not use the house/riad for any purpose other than that of a holiday.

The number of people staying in the house/riad must not exceed the maximum permitted, and should be notified when booking.

You must not use the house/riad for any activity or in such a way as to cause nuisance or annoyance to visitors, neighbours or the owner.

You must allow anyone authorised by Richard Kirker Holiday Villas to enter the house/riad during the holiday. We will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.

Richard Kirker Holiday Villas does not accept any liability for any activity of any sort occurring at adjoining properties.

Web Site and promotional material

We make every effort to ensure that the information and house/riad descriptions contained on our web site and in any other promotional material are accurate. We do however reserve the right to make changes and we accept no liability for minor inaccuracies.

Dogs – Les Noyers only

Well behaved dogs are normally allowed at Les Noyers and must be declared when booking. Please note that dogs are not allowed in the bedrooms or on the lounge furniture, and must not be left in the house alone. You are responsible for the costs of all damage caused by your pets.

No pets allowed at Riad Najmati.

Smoking

Les Noyers and Riad Najmati are strictly NO SMOKING. Anyone found smoking in the properties will be in breach of the contract. Smoking outdoors is permitted but we would ask that stubs would be contained and disposed of safely and not on the ground or terrace.

Vehicles – Les Noyers

In the interest of the visual amenity of the site and personal safety guests are requested to park in the attached car parking area.

Passport, visa and health requirements

It is your responsibility to ensure that these are met so as to permit entry into France/Morocco and to re-enter your country of origin.

It is your responsibility to ensure your passport, and where necessary, visa and health requirements are in order.

For UK passport holders this includes 6 months validity on the passport beyond the date of return from Morocco. Richard Kirker Holiday Villas cannot be held responsible for missed holiday or repatriation costs caused by the failure to meet these requirements.

Data Protection

All personal data provided to Richard Kirker Holiday Villas will be held and processed in accordance with the requirements of the 1998 Data Protection Act. We will keep your personal data safe and secure. We will not share it with other organisations without your knowledge and consent, unless required by law to do so.

If you are interested in a two-center holiday (ie staying in both properties) please enquire about the special deals available. There are good connections between Toulouse (France) and Marrakesh (Morocco). It is feasible to leave one in the morning and to arrive at the other on the same day. Allow approximately 7-9 hours door to door.
